Welcome to the affiliate program for The Feral Housewife LLC (“we,” “us,” or “our”). By signing up as an affiliate, you (“Affiliate,” “you,” or “your”) agree to comply with these terms and conditions (“Agreement”). This Agreement governs your participation in our affiliate program for promoting kratom products sold through feralhousewife.co (“Website”).
1. Enrollment in the Affiliate Program
1.1 Eligibility: You must be at least 21 years old to participate. By applying, you confirm that you meet this requirement.
1.2 Approval: Upon completing the affiliate application, we will review and notify you of acceptance or rejection. We reserve the right to accept or reject any application at our sole discretion.
2. Affiliate Responsibilities
2.1 Promotion: Affiliates may promote our kratom products only using approved marketing methods and materials provided by us or otherwise approved in writing.
2.2 Compliance: Affiliates must comply with all applicable laws, regulations, and industry standards, including but not limited to:
- Federal Trade Commission (FTC) guidelines regarding endorsements and testimonials.
- Advertising policies specific to kratom products.
2.3 Restricted Activities:
- Affiliates may not use misleading or deceptive marketing.
- Affiliates may not engage in spam, unauthorized email campaigns, or similar activities.
- Affiliates may not promote kratom products to individuals in jurisdictions where kratom is banned or restricted.
2.4 Prohibited Content: Affiliates may not host or share content that:
- Promotes illegal activities.
- Contains obscene, defamatory, or hate speech.
- Violates intellectual property rights.
2.5 Affiliate Links: Affiliates will be provided unique referral links. You must ensure these links are accurately used to track sales.
3. Commissions and Payment
3.1 Commission Structure: Affiliates earn 10% of the net sales value (excluding taxes, shipping, and discounts) of completed transactions generated through their unique affiliate links.
3.2 Payment Schedule: Commissions are paid monthly via Zelle or PayPal once your balance exceeds $25.
3.3 Refunds and Chargebacks: Commissions are not paid on refunded or charged-back transactions. If a commission has already been paid, the corresponding amount will be deducted from future payouts.
4. Term and Termination
4.1 Term: This Agreement begins upon acceptance of your application and continues until terminated by either party.
4.2 Termination by Affiliate: You may terminate this Agreement at any time by notifying us in writing.
4.3 Termination by Us: We may terminate this Agreement at any time for any reason, including but not limited to:
- Breach of this Agreement.
- Misrepresentation or misuse of affiliate links.
4.4 Effect of Termination: Upon termination, you must cease all promotion of our products and remove all affiliate links from your platforms.
5. Intellectual Property
5.1 License: We grant you a non-exclusive, non-transferable, revocable license to use our trademarks, logos, and promotional materials solely for the purpose of fulfilling your obligations under this Agreement.
5.2 Restrictions: Affiliates may not alter, modify, or create derivative works of our intellectual property.
6. Confidentiality
6.1 Affiliates must not disclose or use any confidential information about The Feral Housewife LLC, its products, or its customers for purposes unrelated to this Agreement.
7. Limitation of Liability
We are not liable for any damages, loss of income, or harm resulting from participation in the affiliate program. Affiliates participate at their own risk.
8. Modifications
We reserve the right to modify this Agreement at any time. Affiliates will be notified of any changes, and continued participation in the program constitutes acceptance of the revised terms.
9. Governing Law
This Agreement is governed by the laws of the State of Florida, without regard to its conflict of laws principles.
